Land scam: HC stays T'gana order nixing sale deed

HYDERABAD: In a contemporary twist to the alleged Miyapur land scam involving 690 acres, the Telangana high court docket on Tuesday stayed the state government's order cancelling the four sale deeds. The HC also found fault with the federal government for cancelling the sale deeds unilaterally when the state itself was some of the claimants. Both the state and accused were ordered to care for established order on the disputed 690 acres till the pending litigation over land title within the Supreme Court is settled.

The HC's period in-between order came in two writ appeals filed through two accused, PS Parthasarathy and Suvishal Power Gen Ltd, against a unmarried pass judgement on order that had concluded the state's action was unlawful but declined to stick the cancellation of sale deeds.


A bench of Acting Chief Justice Raghavendra Singh Chauhan and Justice A Rajasheker Reddy stated: "State and private parties have conflicting claims over this land and there is a dispute pending before the Supreme Court over the title. In this background, the state, being one of the claimants, cannot unilaterally cancel the sale deeds."


HC orders established order in land case

The bench stated: “State has to file a civil go well with in quest of title, nevertheless it cannot cancel the sale deeds even ahead of the title may well be decided. We are staying this cancellation order handed through the state through its Serilingampalli MRO.”


But taking into account apprehensions through AG BS Prasad, who described the sale deeds as a fraud perpetrated against the state, the bench ordered established order asking both events not to create any third-party interests over the land till title dispute was in any case decided through SC. The AG had argued that the accused connived with some sub-registrars to turn the 690 acres as ‘Inam land’ and have shyed away from paying stamp duty through claiming there was no sale as they'd simply registered transfer of ‘sanad rights’ (grant through king). “We suspended sub-registrars and arrested them together with different accused. The aid granted through this court docket may have an influence on the trial in this case,” the AG stated. But the bench assured him that Tuesday’s stay order would not preclude the state from pursuing the case ahead of the trial court docket.
