BHUBANESWAR: The Election Commission of India (ECI) on Tuesday rejected the Odisha executive's recommendation that it ensure that a 5 in line with cent electoral reservation for transgender people in Lok Sabha, Rajya Sabha, Assembly and municipal elections.
Seats within the assembly and parliamentary constituencies are reserved for people belonging to scheduled castes and scheduled tribes simplest, in line with the provisions on Article 330 and 332 of the Constitution of India.
"Under the existing law, there is no provision in the Constitution or in the Delimitation Act, 2002 to reserve seats for any category including the third gender, as requested by you," said an reputable communication from the ECI to the Third Gender Surakshya Trust.
The Trust had previous submitted its demand prior to the Odisha executive seeking 5 in line with cent electoral reservation to people belonging to the third gender in different polls.
The ECI additional added that as in line with the Delimitation Act, 2002, the seats in legislative assemblies of all states and union territories together with Odisha and the seats within the House of People had been accordingly reserved for scheduled caste and scheduled tribes through the then Delimitation Commission on the basis of census figures of 2001.
"Besides, there is no provision for reservation of seats in Rajya Sabha for any category. The subject matter of reservation in local bodies is under the jurisdiction of state election commission of the respective states," the ECI letter learn.
Members of the transgender neighborhood, however, are upset over the ECI's letter and are planning to transport courtroom not easy a reservation.
"It was the ECI that gave the 'third gender' status to the community in 2009. Now, when the Supreme Court has already given us a minority status like it has to those belonging to the scheduled castes and scheduled tribes, why can't we be given reservations in polls? We are planning to go to court in demand of our rights," said Pratap Sahu, secretary of the Third Gender Surakshya Trust.
