‘No extension for objections over removal of encroachments around IAF ammunition depot’

CHANDIGARH: The Punjab and Haryana top courtroom has directed the Gurgaon district management not to extend closing date for submitting of claims and objections with regards to removal of buildings inside of 300 metres of the Indian Air Force (IAF) ammunition depot. The courtroom mentioned an extension must be granted just for extraordinarily compelling reasons.

The HC passed these orders after staring at that the Gurgaon management, on request of some resident welfare associations, had already prolonged the date of inviting objections to June 22.

“As of now, we can now not comment upon the discretion already exercised through the deputy commissioner, Gurgaon to direct that no additional extension might be granted until there are legitimate and compelling reasons. Authorities are directed to determine the individual’s claims/objection and assess the repayment based on legislation,” observed a department bench headed through Justice Surya Kant.

In its recently-released orders, the bench has also directed the district government to publish compliance experiences relating to evaluation of repayment of the individual claimants before the HC through July 17.

During the listening to of the case in the HC on May 24, the Gurgaon deputy commissioner (DC) had filed a standing document informing the courtroom that according to the attention issued beneath Section nine of the Works of Defence Act, 2900 objections/claims were gained from the persons through May 15. However, on request on some residents’ welfare associations, the period of time to document objections have been prolonged until June 22.

The Faridabad district management knowledgeable that one month notice has been issued beneath the Act, relating to removal of encroachments inside of 100 metres around the IAF station, Dabua and until date 40 objections were gained. The closing date for notice in Faridabad would come to an end on June 19.


The subject had reached the top courtroom in 2010 thru a public interest litigation (PIL) in search of removal of buildings from 100m house around the Air Force Station, Dabua and construction inside of 900m around IAF station in Gurgaon.


Following courtroom intervention, the central govt in September 2015 had instructed the HC that the restricted zone around ammunition depot of IAF in Gurgaon have been reduced from 900 to 300m. In Faridabad, the restricted zone would proceed to be 100m.


On July 28, 2016, the Centre designated each the DCs of Gurgaon and Faridabad as creditors beneath the Works of Defence Act 1903, empowering them to take action accordingly.
