SC refuses to interfere with Delhi HC order granting bail to Karti Chidambaram

NEW DELHI: The Supreme Court these days refused to interfere with a Delhi High Court order granting bail to Karti Chidambaram, son of former Union minister P Chidambaram, for alleged monetary irregularities related to INX Media.

When it comes to the query of liberty, the courts do not cross into technicality, a bench of Justices A Okay Sikri and Ashok Bhushan mentioned.

The bench mentioned it is not interfering with the bail granted to Karti however was leaving the query of regulation open -- on whether he can method the high court docket when his utility for bail was already pending earlier than the trial court docket.

Additional Solicitor General Tushar Mehta, showing for the CBI, mentioned this query of regulation has to be kept open as invoking powers of concurrent jurisdiction of high court docket is also a case of "forum shopping".

Senior advocate Kapil Sibal, showing for Karti, mentioned there is already a judgement wherein concurrent jurisdiction of high court docket can also be invoked.

On June 25, the CBI moved the apex court docket challenging the high court docket order granting bail to Karti.

The probe agency claimed in its enchantment that it was "impermissible in law" for the high court docket to entertain Karti's bail plea when an utility in search of a an identical reduction was pending earlier than the trial court docket.


On March 23, a single pass judgement on bench of the high court docket granted bail to Karti, who was arrested on February 28 by way of the CBI, saying the relief will have to no longer be refused until the crime was of the "highest magnitude" entailing "severe punishment".


Karti was arrested from Chennai in connection with an FIR lodged on May 15 ultimate 12 months, which had alleged irregularities within the Foreign Investment Promotion Board (FIPB) clearance given to INX Media for receiving finances of about Rs 305 crore from out of the country in 2007 when his father P Chidambaram was Union finance minister.


Both Chidambaram and Karti have denied all allegations made by way of CBI, as well as the Enforcement Directorate.


The CBI initially alleged that Karti gained Rs 10 lakh as bribe for facilitating the FIPB clearance to INX Media. It later revised the figure to USD 1 million.
