APSC scam: HC notice to government on judge appt

GUWAHATI: The Gauhati top court docket on Friday issued a realize to the state govt asking to document its reply mentioning explanation why it has not yet complied with a prior court docket order directing appointment of a retired judge to inquire into alleged anomalies in the civil services examinations carried out by way of the Assam Public Service Commission (APSC).
The top court docket’s response came after RTI activist Okram Prasanta Singha moved the court docket filing a civil contempt of the court docket case in opposition to the state govt for not obeying the sooner order.

In 2015, the top court docket, taking on a petition by way of Singha, had ordered the state govt to set up a probe by way of a retired judge to inquire into the alleged anomalies in the APSC selection procedure. Though Rakesh Paul, the top accused in the case, therefore moved Supreme Court difficult the order, the apex court docket pushed aside Paul’s petition in March last year.


The petitioner, Singha, advised TOI, “Since the SC has pushed aside Paul’s plea, the state govt by way of default will have to have obeyed the HC’s earlier order to set up a judicial probe into the scam. But the state govt so far has not acted upon it, which is contempt of court docket. A judicial probe is highly needed for a complete enquiry into the subject to test into the more than a few malpractices in paper environment, valuation, moderation and viva-voce, including the competence of professionals selected for paper-setting and valuation of resolution scripts.”


Singha added that because the police investigation would best center of attention on the felony aspects of the case, like forgery and bribery, only a judicial probe can disclose the opposite administrative malpractices in the system. “There had been studies that lecturers from different topics inspect resolution scripts of other topics, elevating questions upon the marking process of the fee too. That’s why we'd like a judicial probe too,” added the petitioner.


Meanwhile, Dibrugarh Police have filed an extra rate sheet in opposition to six accused persons — Avisika Barua, Sanjan Phukan, Debabrata Dey, Rakesh Gupta (absconder), Mrigen Saikia (absconder) and Mofidul Islam (absconder). Sources said that the state police have also been quizzing a few different civil servants on the basis of the commentary of the accused persons.
