Land ceiling: Patna HC slaps Rs 2L cost on state

PATNA: The Patna top court on Wednesday slapped a value of Rs2 lakh at the state government for now not submitting even a unmarried affidavit in a case of land ceiling in Madhubani district. The case has been pending for listening to since 2004.

The bench of Justice Chakradhari Sharan Singh additionally directed to Madhubani DM to record a counter affidavit within the case and deposit the cost within two weeks’ time.

The matter dated again to February 8, 1983 when the bench of Justice BP Jha had quashed a Madhubani district management’s determination to issue receipts to 27 petitioners towards more than 27 bigha land at Khutauna village beneath Bihar Tenancy Act, 1956. The top court had quashed the order at the basis of procedural lapses within the issuance of receipts.

The land was once in the beginning owned by one Ainul Haq. The bench then had directed the Madhubani management to constitute a board to make a decision afresh on giving receipts to the petitioners on deserves towards the plots beneath the Act.

However, neither a board was once shaped nor the matter got disposed of following which the 27 petitioners moved the top court again on April 21, 2004 and filed a writ petition urging the court that the concerned government of the state government be directed to make a decision the case, which was once remitted again to them by the top court in 1983.


Petitioners’ suggest Yogendra Kumar stated hardly ever a couple of hearings happened within the case as none from the aspect of the land proprietor appeared ahead of the court.


“It was once as soon as taken up by the bench of Justice Birendra Prasad Verma on July 26, 2016, but he refused to listen to the matter as I was his junior in the past. Since then, the matter was once pending for listening to again,” he stated.


Kumar stated the petitioners, because the matter was once remitted again to Madhubani district management, had run from pillar to put up but the government stated they had been not able to trace the land records as the matter was once very old. He stated the cost would be deposited to felony products and services authority for welfare of juveniles.
