CHENNAI: The Madras top court on Friday directed the Tamil Nadu State Marketing Corporation Limited (Tasmac) to document a document on the number of liquor retail shops performing from unauthorised buildings across the state.
A department bench of Justice M Sathyanarayanan and Justice P Rajamanickam also wanted the managing director of Tasmac to inform the court as to the number of such shops functioning in pucca buildings and the stairs taken to care for the spaces in and across the shops in wholesome manner, and to test the regulation and order problems created via drunkards.
The bench handed the order on a plea moved via D Selvakumar, searching for route to the Coimbatore district collector to near a Tasmac store located in the residential house of Masakalipalayam, inflicting great inconvenience to passersby and school going kids.
When the plea was taken up for hearing, the bench said, "this court is prima facie of the view that running the Tasmac shop appears to be against the provisions of the Coimbatore City Municipal Act and the Tamil Nadu Liquor Vending Rules and also against public interest. Hence, there shall be an interim injunction directing the Tasmac to remain closed till disposal of the plea".
The court then directed the managing director of the corporation to document an in depth document as to the department stores functioning in unauthorised buildings and pucca buildings and ordered personal notice to the federal government on a separate plea moved via the petitioner searching for route to the government to finally end up Tasmac with immediate impact.
In that petition, he contended that the organisation Tasmac itself was in violation of the Constitution. "When the Constitution says no one has the right to take others life, the state is doing so through Tasmac by selling liquor to its people," the petitioner said.
