Sessions court rejects SHUATS VC’s bail plea

Allahabad: The Allahabad classes judge on Tuesday rejected the bail utility of Rajendra Bihari Lal, vice-chancellor of Sam Higginbottom University of Agriculture, Technology and Sciences (SHUATS), Naini, in connection with a multi-crore bank fraud case.
Earlier, Lal had surrendered ahead of the trial court on April 15, taken into judicial custody and sent to jail after his utility for interim bail was rejected by way of the court. He has been in jail since then.

Rejecting his bail utility, ADJ (first) Ram Manohar Narain Mishra said that taking into consideration the seriousness of the offence he cannot be launched on bail.

During the court proceedings, the recommend for the applicant contended that there's no evidence against him, subsequently, he's entitled for bail.

However, district government recommend (felony) Gulab Chandra Agrahri hostile the bail utility, saying that the applicant didn't discharge his tasks as head of the establishment. Therefore, he is not entitled to bail.

As in line with a Supreme Court direction dated April five, 2019, Lal had seemed in the trial court on April 15, 2019, and had moved the bail utility in the case. However, the applying was rejected by way of the manager judicial Justice of the Peace. Thereafter, Lal had moved utility for interim bail ahead of further classes judge, who too rejected it, saying that his common bail will probably be heard on next date.


As in line with the case record, an FIR was registered on May five, 2017, by way of assistant vice-president/department manager of Axis Bank, Civil Lines, Allahabad. The FIR was registered underneath various sections of IPC, including cheating and felony conspiracy referring to defalcation through unlawful withdrawals from the accounts of SHUATS held with the said bank. The alleged fraudulent withdrawals bumped into over Rs 23 crores between March 1, 2014 and November 31, 2016.


Later, the police after investigation submitted a chargesheet against the applicant. However, the applicant challenged the chargesheet ahead of the Allahabad prime court, which rejected his utility on March 15, 2019.


Lal then challenged the prime court order ahead of the Supreme Court, which on April five, 2019, declined to intervene. However, it directed Lal to appear ahead of the trial court at Allahabad on April 15, 2019. The apex court additional seen that if Lal so seems, the trial court might consider whether the petitioner is entitled to any reduction of bail.
