NOIDA: RWA federation has adversarial authority directive of proposed punitive motion in opposition to sector RWA presidents/general secretaries in the event that they fail to put in force segregated waste management in residential sectors. A delegation of RWA federation met authority chairman Alok Tandon on Tuesday and raised objections on this regard and demanded motion on devoted waste pickers and landfill web site as an alternative.
A delegation of RWA federation comprising A N Dhawan secretary general, Rajendra Shukla and K K Jain senior vice presidents, Main Pal Singh Yadav vp and Suresh Krishnan treasurer FONRWA, met authority chairman Alok Tandon on Tuesday and raised objections on punitive motion amounting to Rs one lakh effective and 7 years imprisonment prescribed through authority on RWAs and general secretaries in case they do not manage forged waste being generated within the kitchens of the field citizens.
Citing such laws as unlawful, the RWA federation maintained that the position of RWAs in making sure handover of segregated waste to the pickers comes into play handiest after Noida Authority has taken considered necessary steps for selection of such a waste from door-to-door of all households and in addition provided a highway map for landfill websites for his or her dumping. They further asserted that RWAs can work merely in partnership with the local body (read authority) reiterating that responsibilities are discharged handiest with the grant of reasonable rights, therefore tough felony reputation of the powers of RWAs.
"We were quite surprised and shocked to read in the newspapers wherein Noida Authority is reported to have threatened RWAs that in case they do not manage solid waste being generated in the kitchens of the residents, their presidents/general secretaries shall be liable to imprisonment for seven years and payment of penalty of rupees one lakh. In this connection, we drew CEO Tandon's attention to the Solid Waste Management (SWM) Rules 2016, which were also intimated to authority earlier by us, wherein there is no provision whatsoever for the so-called punitive action against the RWAs," said A N Dhawan, secretary general Federation of Noida Residents Welfare Associations (FONRWA).
Dhawan further maintained that in response to rule 4(6) of SWM, the RWAs have merely been required in partnership with the local body (on this case, Noida Authority), to verify segregation of waste at source, facilitate selection of segregated waste in separate steams and handover recyclable subject material to licensed pickers/recyclers.
Dhawan further laid down that during compliance of rule 15 of SWM, local government are required to arrange a forged waste management plan as consistent with State policy/strategy on forged waste management within 6 months from the date of notification of State policy. "They (the local body - read Noida authority) have been assigned to arrange door-to-door collection of segregated solid waste from all households. Local bodies have also been required to frame bye-laws incorporating the provisions of the rules within one year from the date of notification of these rules and ensure timely implementation thereof," said Dhawan.
Additionally, as consistent with SWM laws 2016, local bodies/government are required to undertake development, operation and upkeep of sanitary landfill and associated infrastructure as also to make good enough provision for capital investment in addition to operation and upkeep of forged waste management products and services.
Therefore Dhawan maintained that the RWAs' position of making sure segregation and delivering the segregated waste to the pickers, comes into play handiest after Noida Authority has taken considered necessary steps for selection of such a waste from door-to-door of all households. "Regrettably, Noida Authority has hitherto utterly failed to take all the requisite measures, such as framing of bye-laws, construction, operation/maintenance of sanitary landfill site as also engagement of pickers/recyclers within the stipulated timeframe of one year from the date of notification of the SWM Rules dated April 8, 2016 and as such, has no right to take punitive action against RWAs/residents," said Dhawan.
The RWA federation also maintained that with the intention to discharge their duties in response to authority laws, it is important that RWAs are empowered with due reputation and provided with good enough monetary resources at their command. "Obligations are discharged along with the grant of reasonable rights. Merely requiring RWAs to discharge their obligations of ensuring segregation of waste at source without due recognition and financial resources at their disposal, cannot be justified," said Dhawan who demanded constitutional reputation and felony/monetary empowerment of RWAs.
Apart from this, the RWA delegation also sought answer of alternative pending problems below work circles 1, 4, five and six associated with mission engineers (PE) of civil, jal, E/M, horticulture and well being divisions as determined in an earlier meeting remaining month on Oct 14. "With reference to meeting of two working committees covering work circles 1, 4, 5 and 6, we explained to CEO Tandon that even though, more than one month has lapsed (since Oct 14 meeting), no action has yet been taken on any of the issues raised in that meeting," said K K Jain, senior vp FONRWA.
CEO Alok Tandon stated FONRWA delegation's pleas and promised necessary steps/actions in coming days on all issues. "He forwarded our letter to the chief engineer (civil) for necessary action in this regard," said Jain who together with the RWA delegation also met H S Yadav chief engineer and marked a replica of their letter to R K Mishra, further chief govt officer (ACEO) and Rajesh Kumar Singh officer on special accountability (OSD), Noida Authority.
