ALLAHABAD/GORAKHPUR: The Allahabad high courtroom on Monday rejected the bail plea of former principal of Gorakhpur's Baba Raghav Das Medical College, Dr Rajiv Mishra, who is among the 9 accused within the death of several youngsters because of alleged disruption in oxygen supply on the hospital closing yr. Dr Mishra has been charged beneath sections 409 (legal conspiracy), 308 (attempt to commit culpable homicide) and 120B of IPC but even so segment 7/13 of the Prevention of Corruption Act.
Declining to grant bail to Dr Mishra, a department bench comprising Justice Ramesh Sihna and Justice D K Singh mentioned: "The order for the release of the petitioner on bail cannot be passed in the present facts and circumstances of the matter." The plea of the petitioner used to be that he had been languishing in prison for the closing seven months. Further, different co-accused have been released on bail in this matter, he pleaded. However, opposing the bail software, the state counsel pleaded that "the case is a very serious one and it was due to the alleged role of the petitioner, the oxygen supply was stopped".
He further alleged that "the petitioner had stopped payment to the company which used to supply oxygen for getting illegal kickbacks (commission). As a result, the company stopped oxygen supply and which resulted into the tragic death of several children in the hospital. Hence, he does not deserved to be released on bail".
