HYDERABAD: With the political turf heating up in anticipation of elections by way of year-end or early 2019, the Telangana govt has written to the Centre again on the want to give a boost to reservations for Muslims and Scheduled Tribes within the state.
The state govt had earlier despatched two Bills, handed within the Assembly in April 2017, to the Centre in search of the President's approval and inclusion in Schedule IX of the Constitution. The Bills enhanced the quota for Muslims from the current 4% to 12% and for Scheduled Tribes from 6% to 10% within the state.
But the dept of staff and coaching (DoPT) shot again a letter to the state govt saying that the verdict was once in violation of the Supreme Court order of 1992 during which the whole quota was once capped at 50%. In its letter, the DoPT stated that the apex court, within the Indra Sawhney case of 1992, had said that "clause (4) of Article 16 of the Constitution speaks of adequate representation and not proportionate representation."
Following this, the Telangana govt consulted prison luminaries and professionals within the topic of reservations and ready a draft report to be submitted to the Centre. Recently, leader minister Ok Chandrasekhar Rao reviewed this draft report, which was once also approved by way of the legislation division, after which it was once despatched to the Centre.
"The state government informed the DoPT that Telangana is a fit case where the 50% cap on reservations can be exceeded. The state government quoted a case in which the Supreme Court had observed that the 50% quota can be exceeded only in extraordinary situations, and while doing so, extreme caution has to be exercised and a special case made out," a senior legit stated.
In its rationalization, the state govt defined that population of STs higher from over 7% within the united Andhra Pradesh to nine.08% in Telangana. Even the share of Muslims went up from nine.56% to 12.68% after bifurcation.
The state govt quoted from the reviews of the BS Ramulu-headed BC Commission, G Sudhir Commission and Chellappa Commission and pointed out that Muslims were lagging behind the state moderate in literacy and employment. Also, over 80% of Muslims in Telangana have been categorized as backward by way of various commissions.
When contacted, leader secretary SK Joshi showed to TOI that the Telangana govt has reiterated the verdict taken by way of the Assembly that handed the Bills.
