HC denies bail to accused in Gurugram school murder case

CHANDIGARH: The Punjab and Haryana prime courtroom on Wednesday disregarded the bail plea of teenage boy, Bholu who's accused of killing of 7-year-old Prince of a non-public school in Gurugram district.

Justice Daya Chaudhary handed these orders while pushing aside the enchantment filed through the accused who was named as Bholu through courtroom to verify his identification is not printed. Similarly, the deceased has been named as Prince through the courtroom.

In his bail plea, the 16-year-old accused had challenged the orders handed through the Juvenile Justice Board, Gurugram and the Gurugram district and periods courtroom in which he was denied bail.

Main argument of the accused boy was that he should be launched on bail, as the investigating company, CBI had now not filed its ultimate investigation report inside the one-month time prescribed within the legislation for the juvenile offenders.

Dismissing his plea, the HC upheld the arguments of CBI that appellant's case falls within the class the place length of presentation of challan is 90 days.

On November 15, 2017, Juvenile Justice Board, Gurugram had denied bail to the accused.

Later, his enchantment against the order was disregarded through the Gurugram district and periods courtroom on January 8, 2018.

In this situation, the accused were in the hunt for bail at the grounds that juvenile offenders should be launched on bail if the investigating company fails to put up chargesheet or ultimate investigation report against him within one month.


The CBI, via its counsel Sumeet Goel, had argued that the required length for submitting a chargesheet is 90 days beneath CrPC provisions as the accused were declared an adult through the Juvenile Justice Board (JJB).


On September 8, 2017, the body of seven-year-old Prince was found inside of the toilet of the college, together with his throat slit. Initially, the matter was investigated through the Haryana Police, which had booked a bus conductor of the college for killing the class-II pupil. However, later the case was referred to CBI for probe.


The premier company had arrested Bholu, a pupil of Class XI, of the similar school for killing Prince.
