Pak-born man takes oath of allegiance after 50 yrs

MUMBAI: Six months after the Bombay prime court docket directed the government to believe a citizenship plea through a Pakistan born guy residing for 50 years within the town, the Mumbai collector administered him an oath of allegiance. The oath is the primary reliable step towards grant of citizenship.

The court docket, granting Asif Karadia (53) coverage against deportation in January, had observed after listening to his legal professional Sujay Kantawala and govt pleader Purnima Kantharia that it was a “distinctive case.” Karadia returned to India as an infant after being born in Pakistan.

His father, Abbas Karadia, is an Indian citizen. He had got married in 1962 in Gujarat to a woman who had a Pakistani passport, which mentioned she was born in Mumbai. The HC observed that “even though conceived in India, as in step with customs, his (Asif ’s) mom went to her parents’ position in Karachi where he was born on April 19, 1965.” The mom and kid got here to India in 1967 and have resided right here since. Asif has been residing on long-term visas. He lives in Nagpada with his family.

The father had filed the petition jointly to hunt Indian citizenship for his son after a deportation scare. Asif implemented for citizenship in March 2015. Their case was that below Section 5 of the Citizenship Act, Asif was eligible to be granted Indian citizenship. Besides, Article 5 of the Indian Constitution allows a person, “both of whose parents was born within the territory of India”, to turn into a citizen.

Asif ’s identify was stamped on his mom’s Pakistani passport after his birth in Karachi. However, in 1972, the Indian govt granted citizenship to his mom after she surrendered her Pakistani passport. Asif married an Indian girl and has three kids, who're Indian citizens.

Will undergo process, says dad of Pak-born guy

Under the Citizenship Act, Asif pleaded he was entitled to citizenship through descent, registration and naturalization. Finally, the Mumbai town collector on May 25 despatched Asif a letter asking him to return and take oath of allegiance on May 31. He did. The oath is to “solemnly affirm within the identify of God” that he would “undergo true faith and allegiance to the Constitution of India… and will faithfully apply the regulation of India” and “fulfil my tasks as citizen of India”. The Maharashtra house department had in its affidavit to the HC mentioned that after the house ministry had regularized his stay in India for just about five a long time, he would be required to practice the method for grant of citizenship. His father has mentioned Asif will pass throughout the process as in step with regulation.

His subject is scheduled to return up for listening to next on June 13 prior to the prime court docket. The number might not be unlucky for him.
