Delhi: New feud over transfer of power erupts

NEW DELHI: Just when it kind of feels that both Delhi government and LG Anil Baijal have been ready to bury the hatchet, a new feud over the issue of transfer of power has erupted between them.

Following his 25-minute-long meeting with LG Baijal, CM Kejriwal today alleged that the former has refused to grant the control of services department to Delhi government, in spite of the SC's verdict.

Speaking to media after his meeting with the Delhi LG, first after his sit-in agitation the LG's place of abode, the chief minister mentioned that this is the first instance within the history of independent India that the central government has refused to follow the orders of the Supreme Court.

"If the government doesn’t follow orders of the Supreme Court there will be anarchy in the country," he mentioned.

"Supreme Court mentioned that except for three subjects, police, land and public order, Delhi government will have executive power on other subjects. LG does no longer agree that control of services must be passed over to Delhi government.

"LG sought recommendation from that MHA which informed him that services must no longer be given to Delhi government. It is the first time within the history of India that the Central government has overtly refused to obey the SC's order...," Kejriwal informed newshounds.

Earlier today, following their 25-minute-long meeting, both the LG and the CM had assured every other of improve and cooperation.

"Met Honourable CM Arvind Kejriwal and Honourable deputy CM Manish Sisodia. Assured them of my continued improve and cooperation within the pastime of good governance & total building of Delhi as in keeping with the letter and spirit of Constitution," Baijal tweeted.

Kejriwal thanked Baijal for his improve and mentioned that the order of the SC will have to be revered.


The LG also spoke back to Kejriwal's letter, written on Thursday, soliciting for his improve and cooperation.

Assuring the Delhi chief minister of his improve, the LG mentioned that NCT of Delhi does no longer have the status of 'State; under the existing constitutional scheme.

On the question of 'Services', the LG cited a 2015 Government of India notification mentioning that 'Services' fall out of doors the purview of Legislative Assembly of NCT of Delhi.

"Consequently, Government of NCT of Delhi will haven't any executive powers in relation to 'Services'," he added.



Hours after the Supreme Court's landmark judgement previous this week, the Delhi government presented a new device for transfer and postings of bureaucrats, making the chief minister the approving authority.


However, the services department refused to conform, announcing the Supreme Court did not abolish the notification issued in 2016 which made the MHA the authority for transfers and postings.
