Cops attach property over failure to remove debris

PUNE: The Pune police on Wednesday sealed and attached Shree Haripriya Sabhagriha, a sought-after multipurpose recreational hall located on the banks of Mutha river off Sinhagad road, after its owner, Datar Farms, did not agree to an August 27 order by means of the National Green Tribunal (NGT) in the hunt for to remove encroachments and debris from the river bed.

NGT’s fundamental bench in Delhi had directed the city police commissioner to glue the valuables if Datar Farms, headed by means of Anjali Dinkar Datar, fails to transparent the debris within 3 months. The closing date ended on November 27. The attachment is to stay in power until Datar Farms complies with NGT’s instructions.

Senior inspector Devidas Gheware of Dattawadi police instructed TOI, “A compliance report of the police action will be despatched to the NGT. We have videographed all of the action of sealing all get right of entry to to the valuables, taken photographs, drawn up a panchanama and made a station diary entry in relation to the valuables attachment.”

When contacted, Datar’s legal professional Chinmay Vaidya stated, “We have filed an attraction against the NGT’s August 27 order in the Supreme Court and the similar is anticipated to be heard in the end. Our high rivalry in the attraction is that the consent terms drawn on March 16, 2016, on the foundation of the maps that were then placed prior to the tribunal, were modified ‘unilaterally’ by means of the manager engineer of the irrigation department by means of drawing fresh flood simple/blue line in the river bed.”

Vaidya added, “We instructed the NGT that the consent terms may just no longer have been modified after they were finalized however, the tribunal didn't accept our submission. We then approached the Bombay High Court which quashed the tribunal’s order because it used to be passed by means of a single-member bench as a substitute of the mandatory two-member bench and the topic used to be referred again to the tribunal’s fundamental bench. Unfortunately, there used to be no one to properly constitute our aspect prior to the fundamental bench on August 27. Now, we have challenged the order in the SC.”

Architect-activist Sarang Yadvadkar, who had approached the NGT for removal of the debris, stated, “The police’s action as of late is the result of no longer following NGT’s instructions of 2016. We really feel folks must respect the judgments given by means of the NGT. The large encroachment had endangered the natural glide of water in the river bed and the similar would have brought about difficulty to folks in a flood situation.”
