NEW DELHI: The National Green Tribunal (NGT) has refused to entertain a plea through the East Delhi Municipal Corporation (EDMC) looking for land to regulate rubbish on the Ghazipur landfill website, saying that dispute of departments is to be resolved on the administrative degree.
The inexperienced panel stated the problem of availability or suitability of the website for the landfill and its allotment is to be looked after out between the EDMC and the Delhi Development Authority (DDA) in keeping with the legislation.
"We have considered the matter. We find difficult to pass further orders on the applications. The matter pending before the tribunal already stands disposed of. Inter se dispute of departments is to be resolved at administrative level. Jurisdiction of the tribunal is to provide remedy to a victim for environment protection against action taken in violation of norms," a bench, headed through NGT Chairperson Justice Adarsh Kumar Goel, stated.
"Rules are in force which have to be followed. Applicants do not have grievance against the authorities which may fall under Sections 14 and 15 of the NGT Act, 2010," it stated.
The inexperienced panel also stated that it used to be leaving the problem to be dealt through the authorities concerned without expressing any opinion on deserves at this degree.
The saturation of the Ghazipur landfill website and the non-availability of alternative land to regulate rubbish had precipitated the EDMC to transport the NGT.
The EDMC had moved an application, looking for direction to the DDA handy over a piece of land at Sonia Vihar and a plot at Ghonda Gujran for forged waste management amenities on a priority foundation.
Advocate Balendu Shekhar, appearing for the EDMC, had stated the 2 pieces of land had been licensed and appraised through the Central Pollution Control Board and it will have to be handed over to the company for dealing with municipal forged waste.
The DDA, represented through suggest Kush Sharma, later instructed the tribunal that in response to the reports of the CPCB and the National Environmental Engineering Research Institute (NEERI), an area of 88 acres at Sonia Vihar and a 42.5-acre plot at Ghonda Gujran can be given to the EDMC for dealing with and processing waste.
