CHANDIGARH: The Punjab and Haryana high court on Monday issued fresh notices to former Punjab deputy leader minister Sukhbir Singh Badal and former revenue minister Bikramjit Singh Majithia for making statements against Justice Ranjit Singh inquiry commission that probed sacrilege cases within the state. Both of them were asked to reply the issue by way of April 29.
Earlier on Monday morning, Justice Amit Rawal had issued bailable warrants against both the leaders for non-appearance despite issuing of court notices. The HC issued warrants as both the leaders had no longer gained the summons despatched to their addresses by way of the high court in regards to the case.
However later, the bench recalled the orders referring to issuance of warrants and ordered to serve notice to the SAD leader at his respectable MLA flat. HC also decided to factor fresh notice to Majithia for the reason that particulars of case weren't written accurately within the earlier summons.
HC has issued the notices to the two whilst hearing a petition filed by way of Justice Ranjit Singh (retired) seeking legal motion against them for statements against the commission headed by way of him.
Justice Ranjit, who had retired from the Punjab and Haryana high court, has sought the motion against Badal junior and Majithia as in line with segment 10-A of the Commission of Inquiry Act. The segment supplies for penal motion against the acts that carry the commission or any of its members disrepute.
"If any person, by words either spoken or intended to be read, makes or publishes any statement or does any other act, which is calculated to bring the Commission or any member thereof into disrepute, he shall be punishable with simple imprisonment for a term which may extend to six months, or with fine, or with both," says the provisions mentioned in segment 10-A of the Act.
In his petition, Justice Ranjit has cited two cases where former deputy CM and his brother-in-law had allegedly made statements against the commission and had acted in a manner to disrepute the commission and its head.
Rejecting Justice Jora Singh commission record on the sacrilege factor, Captain Amarinder Singh-led Congress govt had constituted a fresh commission of inquiry headed by way of Justice Ranjit Singh on April 14, 2017, to analyze all cases of sacrilege in Punjab. The commission had submitted its first record on June 30, 2017, and final record on August 29, 2018.
