SC upholds HC order denying bail to ex-MLA in MCOCA case

NEW DELHI: The Supreme Court as of late upheld the decision of the Delhi High Court denying statutory bail to a former MLA who used to be arrested in December 2016 for offences below the stringent MCOCA.
A bench headed through Chief Justice Dipak Misra mentioned that there used to be "no infirmity" within the top courtroom order because the Delhi Police had already filed a plea before the trial courtroom searching for extension of time beyond the statutory length of 90 days for filing the fee sheet in opposition to former town MLA Rambeer Shokeen.

Shokeen, who used to be booked below the Maharashtra Control of Organised Crime Act (MCOCA) for allegedly running against the law syndicate in Delhi and adjoining states along side others, had alleged that he used to be entitled for grant of statutory bail because the police had sought extension of time for filing the fee sheet after the expiry of 90-day length.


"We find no infirmity in the said approach of the high court. Having extended the time till March 8, 2017 and as the charge sheet was already filed on that date, the question of considering the prayer for grant of statutory bail of the appellant vide application dated March 2, 2017, on the ground of default, did not survive for further consideration," the bench, also comprising justices A M Khanwilkar and D Y Chandrachud, mentioned.


The best courtroom, then again, mentioned that rejection of the prayer for grant of statutory bail would not are available the way of Shokeen pursuing his treatment for grant of standard bail.


The ex-MLA had challenged certain orders passed through two special courts contending that his judicial custody beyond February closing used to be unlawful.


Shokeen had contended that he used to be entitled to be launched on bail because of the lengthen at the part of the investigating agency in finishing the probe and filing its fee sheet within the statutory length.
