Juvenile's conviction for rape upheld

GURUGRAM: A Rewari periods court upheld a May 2017 order through the juvenile justice board (JJB), sentencing a kid in war with legislation (CCL) to three years at an commentary house. The juvenile have been convicted for raping his neighbour, a mentally challenged 20-year-old lady in Mundra village of Rewari, while she had long past out to alleviate herself in February 2016.

The order was once challenged through the juvenile in the periods court, on the grounds that it have been handed without recording the survivor's remark. Additional consultation judge primary (retired) Phalit Sharma, on February 21, upheld the JJB order, observing that during case the survivor is mentally challenged, her remark is not necessary for conviction.

In his remark ahead of court, the survivor's father, who is the complainant, said at about 2pm on February 6, 2016, the girl had long past to the mustard box close to their area to alleviate herself. Minutes later, when he heard her cry out from the fields, he went there and witnessed the juvenile - his neighbour's son - raping his daughter.


When he referred to as upon the juvenile's family, the juvenile's elder brother threatened to kill the survivor if the subject was once reported to police.


The survivor's family then approached police. An FIR was once registered , and the survivor's medico-legal examination performed. Following procedure, the juvenile was once taken into protecting custody.


During the JJB's hearings, the survivor's mom said her daughter can't speak because of her psychological incapacity. The juvenile's counsel argued that the JJB had handed an order only on the foundation of statements through the complainant. The court seen that the court was once no longer vulnerable to take a lenient view on this case, as the boy who had raped the mentally challenged lady was once over 15 years of age at the time.
