GHAZIABAD: The Federation of Apartment Owners’ Association filed a PIL in the Allahabad excessive courtroom on Wednesday, not easy sealing of all unlawful shops and industrial institutions running out of residential buildings in Indirapuram. The federation has alleged that the Ghaziabad Development Authority has became a blind eye on the subject.
The federation stated it had filed the PIL after making several proceedings to the GDA that reportedly went unheard. The proceedings had been filed on the foundation of replies to RTI queries in which the GDA had clarified that no permission whatsoever had been given to behavior industrial actions from residential buildings.
It has been alleged in the PIL that industrial institutions, including banks, beauty parlours, saloons, cafes, gyms, restaurants, departmental shops and clinics, were running illegally from several residential devices in Indirapuram. Many buildings in densely populated spaces like Ahimsa Khand 1 and a couple of, Nyay Khand, Niti Khand, Abhay Khand, Gyan Khand and Shakti Khand had both been rented or leased out for industrial actions.
In October 2016, former GDA vice-chairperson Vijay Yadav had ordered a survey of the residential spaces in Indirapuram to identify unlawful industrial institutions. Yadav had confident the apartment house owners that action would be taken in accordance with the regulation after identifying those institutions.
“However, there was no follow-up through the GDA. Unauthorised shops and industrial devices shouldn't have parking spaces of their own. Hence, automobiles are left on the street on every occasion a customer visits any of these shops. It ends up in congestion and site visitors jam,” federation president Alok Kumar told TOI.
“In addition, shops and other industrial institutions are also running out of several high-rise housing societies. Convenience shops were authorized in the layout maps of a few workforce housing societies. These are intended for the exclusive use of residents of that specific society. However, in numerous instances, boundary partitions of societies were pulled down to permit the use of those comfort shops through most of the people,” Kumar added.
The PIL has also highlighted instances of air and noise pollution as a result of continuous honking and congestion of automobiles on roads the place shops operate illegally.
The PIL has been filed on the foundation of a Supreme Court order of 2011 that barred banks and other industrial institutions from functioning out of residential sectors in Noida.
