HYDERABAD: The Telangana State Industrial Infrastructure Corporation (TSIIC) has hit a registration rule hurdle in cancellation of sale agreements of commercial plots, value crores of rupees by which allottees did not arrange units or fulfil other stipulations. After figuring out 1,300 acres of unused parcels of land and cancelling allotments to a lot of them, TSIIC needs to resume land parcels in business estates.
However, majority of the allottees had been refusing to surrender land due to which cancellation of registered sale agreement at the sub-registrar workplaces with the consent of each events isn't taking place. The Registration Act says unilateral registration cancellation is appropriate only for government departments like earnings and woodland. Corporations like TSIIC and forums won't fall below this category.
An authentic of TSIIC informed TOI, “All these allotments had been made ahead of the formation of Telangana. After the brand new state got here into being, we are taking all preventive steps and doling out best to those companies which are in a position to putting in units. Regarding the old allotments, we are facing a serious factor of sale agreement cancellation when the corporations fail to start business units. During allotment, the firm is supposed to pay the fixed land price in business estates for plots and sale agreements are carried out by way of TSIIC in favour of the birthday party after accumulating the sale attention price. Therefore, cancellation of unused land allotments is putting within the balance and we can’t add them to the vacant plot listing.”
The authentic mentioned some industrialists had been coming out brazenly and surrendering the vacant plots and land allotted to them. But the vast majority of them had been reluctant. The Telangana Housing Board (THB) may be facing similar problems. THB vigilance authentic Aruna Kumari mentioned,”We have lately written to the registration and stamps division following a writ petition filed against allotment in Vijayanagar Colony within the town. We have asked the registration and stamps division to cancel the allotment as it was not in step with norms.”
Experts say the Act will have to be amended to include government-owned corporations and our bodies for unilateral cancellation of registered deeds. Registration and stamps division DIG, Ranga Reddy, VV Naidu mentioned, “Only government or a government division can do cancellation of registration unilaterally. As a registration agreement is a freelance, each the events have to agree for cancellation in other circumstances. Government-owned our bodies or corporations are not incorporated within the exemption clause.”
