After 2 years in jail for rape, suspect gets bail as DNA does not match newborn

MUMBAI: Two years after a Bhiwandi early life was once arrested for allegedly raping his 16-year-old neighbour, the Bombay prime court recently launched him on bail after the DNA of the child born to the survivor didn't match that of the accused. Justice Revati Dere ordered that the accused, Vikas Mali, be launched on a personal bond of Rs 15,000.
Mali was once booked underneath section 376 of the Indian Penal Code for rape and for irritated sexual attack underneath provisions of the Protection of Children from Sexual Offences Act (Pocso). If convicted, he faces a minimum punishment of 7 years in prison and a maximum of life imprisonment.


"The DNA report received from the Forensic Sciences Laboratory in September 2017 shows that the accused is not the biological father of the child that was born to the victim. He is in custody for almost two years. The investigation is complete and a chargesheet has been filed," stated the pass judgement on, adding that during gentle of "the peculiar facts and circumstances of the case", the accused deserves bail.


Mali was once arrested in March 2016, after the survivor, a minor, alleged he sexually assaulted her. In her complaint, she claimed that the accused had expressed his love for her and had taken her to his area to have bodily relations. She alleged that he had confident her that he would marry her and had sexual relations together with her again (September 2015), following which she became pregnant. She delivered a child in June 2016.


Mali claimed that he was once falsely implicated in the case and there was once a lengthen in accommodation the FIR. His bail were rejected by means of the Thane periods court two times. The DNA results weren't available with this court.


The trial court had seen: “The sufferer was once a minor at the time of incident. Out of the bodily relations between the sufferer and the accused she has delivered a child. The offence is serious; for those reasons the accused is not entitled to be launched on bail.” The prime court, releasing Mali on bail, restrained him from coming into the village the girl resides at or making any makes an attempt to threaten witnesses or tamper with evidence.
