CMM orders to register case against RTO

KANPUR: Chief metropolitan magistrate (CMM) Kanpur Nagar on Tuesday ordered to check in a miscellaneous case towards the regional transport officer (RTO) while looking for record relating to seizure of a vehicle.
The transport officer had challaned a loader of Sushil Kumar, resident of Ata village in Akbarpur tehsil on January 11 for violation of visitors rules.

Sushil made a number of rounds of the transport office asking the officials to ship the challan in the court docket but they didn't ship the similar.

He then filed an software in the CMM court docket on April 23, and the court docket sought a record from the RTO. Though the transport reliable had sent the challan to the court docket but stated in his record that beneath segment 468 of CrPC, he has the fitting to ship the challan any time inside of six months.


The assistant public prosecutor (APP) said the CMM in his reply stated that Allahabad high court docket in Krishna Dev Vs State had already dominated that the challan must be offered in the court docket inside of seven days.


The transport commissioner too vide his order dated December 30, 2012 had directed the all transport officers to submit the challan in the court docket inside of one week, said APP.


When the CMM found that instead complying with his orders, the RTO was once teaching him about the law, he then ordered to check in a case towards the RTO, the APP added.
