HC upholds life sentence in murder case

BENGALURU: The Karnataka top courtroom has upheld the life sentence awarded to a person who had robbed and killed a 75-year-old woman who was once living very on the subject of his area.

“On re-appreciation of all of the subject material on report, it's observed that the prosecution has established the chain of circumstances main up to the loss of life of deceased Gangamma. The oral and documentary proof on report unerringly level the palms toward the guilt of the accused,” a division bench has observed while brushing aside the criminal appeal filed through Lakkanara Nagaraj, an agriculturist from Bagali village in Harapanahalli taluk of Davanagare district.

On March 29, 2006, districts and session pass judgement on Davanagere had convicted him protecting him to blame below sections 457 (trespass), 392 (theft) and 302 (murder) of the IPC. The incident had happened on May 12, 2005 at about 11pm.

The case of the prosecution was once that Nagaraj - with an intention to commit theft of gold adorns, money and other articles saved in the metal trunk - trespassed into Gangamma’s area, which was once located just one block away. When the accused attempted to return out of the home, Gangamma woke up and screamed.


Apprehending that his act of theft will unfold to villagers, Nagaraj murdered her through compressing/strangulating her.


Upon listening to her scream, Chennaveerappa, who was once snoozing in the front backyard of the home, woke up and rushed to Gangamma’s area along with Kenchappa and so they saw Nagaraj coming out with metal trunk in his hand. When they enquired him about it, he did not give sufficient reply and so they in turn informed Patragouda, a relative of Gangamma.


When Patragouda, the complainant to whom Gangamma was once maternal aunt, enquired about the trunk in his possession, Nagaraj responded that he would give up the similar to one Manjappa, as according to Gangamma’s request.


However, when all of the three went within the home, they found Gangamma’s body. Upon further enquiry, Nagaraj confessed to them that he killed the lady through compressing her neck. The police then arrested Nagaraj and recovered the metal trunk containing some gold adorns and Rs 7,280 in money.
