MUMBAI: A homeopathy student barred from attending school because she wears the hijab (headscarf) has moved court docket pronouncing she is now being prevented from showing for repeater exams in June as a result of poor attendance.

Bandra resident Fakeha Badami enrolled within the bachelor of homeopathy medication and surgical operation course in Sai Homeopathic Medical College, Bhiwandi, in 2016.



The school, affiliated to the Maharashtra University of Health Sciences (MUHS), didn’t allow her to attend lectures because she wears the hijab.

The ministry of AYUSH (ayurveda, yoga and naturopathy, unani, siddha and homeopathy) directed the college to unravel the problem, pronouncing “it cannot compel a student not to wear the hijab since it's disrespect to social justice”. MUHS wrote to the state medical training and medicine department to know if there used to be any law barring Muslim scholars from dressed in the hijab. It stated she will have to be allowed to attend school.

But the college didn't budge. By the time Fakeha approached the prime court docket the first time, in November 2017, the college exams were over.

Homoeopathy student Fakeha Badami’s school advised the prime court docket that it will accommodate her in repeater lectures. The scholars both stopped dressed in the hijab or left the college. Fakeha’s petition states that she used to be pressured as endured dressed in the hijab. As in line with her petition, her folks advised the college Fakeha wore the hijab even in class and junior school. “India is a... secular democracy. Denying somebody... the right to wear the hijab is denying her the right to practice a religion of her selection, despite such right being obviously safe by means of the Constitution of India as a Fundamental Right below Article 25,” the petition mentioned.


“The school is below obligation to observe secular tenets.” The petition stated Fakeha’s sister, studying homeopathy in any other MUHS school, wears the hijab and is permitted to attend categories. Fakeha’s suggest, Sariputta Sarnath, advised a holiday bench of Justices Shahrukh Kathawalla and Ajay Gadkari on Monday that Fakeha used to be allowed to attend categories simplest after the HC’s March 12 order and her lack of attendance used to be due to the college no longer allowing her to attend categories.


The bench requested him to serve notices to the college and different respondents and posted the hearing for Friday
