MUMBAI: The Bombay high court docket on Wednesday stated it'll no longer permit the Metro-IIB paintings to continue except MMRDA produces the permissions for digging the road at ESIC Nagar, Andheri (W).
“Even whether it is Metro, except we are glad it's prison, we will be able to no longer will let you continue,” stated a bench of Justices Abhay Oka and Riyaz Chagla. It heard a petition by way of JVPD Housing Association, Gulmohar Societies and Nanavati Hospital to direct the Dahisar-DN Nagar Metro corridor be made underground. When informed that barricades had been erected for soil testing on April 24, MMRDA was advised to produce the permission. But its recommend Kiran Bagalia reiterated, “We have intensive powers under the Metro Act. We do not have permissions.” She added that the paintings is being carried out on “public highway, and no longer on non-public roads”. Eleven increased stations are to be constructed along S V Road between Bandra and Andheri for the Dahisar-DN Nagar corridor.
The judges stated MMRDA will have to have produced some order authorizing the digging paintings and in spite of again and again asking, it was no longer answering. “You can’t stay repeating ‘we've got authority’ as otherwise any officer will start digging on roads,” stated Justice Oka.
Bagalia then stated there is not any specific permission however BMC will give it. ``Does that authorise all officials to go on the streets and dig anyplace? Roads do not belong to MMRDA. Are you no longer supposed to coordinate with different agencies?" asked Justice Oka.
Bagalia later informed that MMRDA has entered into a freelance. She stated ``the digging is just for soil testing’’ and no further paintings might be performed till the court docket hears the subject. Posting the hearing on June 12, the judges clarified that her ``observation will stay confined to this stretch of the road.”
