Awaiting confirmation of presence before moving for Nirav Modi’s extradition: Envoy

LONDON: The Indian top commission here has not sought absconding jeweller Nirav Modi’s extradition but as it's nonetheless looking ahead to “formal confirmation” he's in the United Kingdom from the home administrative center.

When contacted by TOI, Indian deputy top commissioner to the United Kingdom Dinesh Patnaik said: “We have approached the United Kingdom side for information but have not received any formal confirmation of the presence of Nirav Modi in the United Kingdom.” He added, “We can not send an extradition request without confirmation of his presence.”


It is understood the top commission has made several written requests to the home administrative center, by way of the international administrative center, in quest of formal confirmation Modi is in the United Kingdom but has had no formal reaction. This is wanted for extradition lawsuits to be initiated.


An Indian diplomat said:“The UK govt has advised us informally that he is in London but we can’t work on casual sources. We need formal confirmation. He can have indefinite depart to remain. We don’t know that he has implemented for political asylum.”


The house administrative center refused to verify or deny whether or not the diamond service provider, who, along with his uncle, Mehul Choksi, is sought after in India in reference to a Rs 13,000 crore Punjab National Bank rip-off, has implemented for asylum or is in the United Kingdom. But the home administrative center said Modi could legally practice for political asylum in Britain.


“It’s completely possible for an Indian businessman like Nirav Modi to apply for political asylum in Britain,” said Paul Turner, an immigration and asylum barrister, who heads Imperium Chambers in London. “Even if there's a criminal case in opposition to him, he can nonetheless practice for asylum.”
