MUMBAI: The Bombay prime courtroom on Thursday slammed a legal professional representing a Hijab wearing scholar who have been denied permission by way of a faculty to first attend classes after which sit down for examinations in May, for filing a review petition with unsuitable statements and warned of imposing Rs 1 lakh as costs, prompting him to withdraw the plea.

Fakeha Badami, a scholar of Sai Homeopathic Medical College in Bhiwandi had moved the courtroom within the May holiday to be allowed to look for final examinations in May 2018, pronouncing her attendance shortage used to be for the reason that school had denied her permission to attend. Counsel for the school, Deepak Salvi, however identified that she has simplest 35 % attendance within the final three months. A bench of Justices S J Kathawalla and Ajay Gadkari wondered the legal professional for making "false statements in the petition" and stated, "why should we not order Rs 1 lakh as costs." The legal professional apologized and stated he would withdraw the petition.


The HC had clarified in May that the scholar "will be allowed to attend the repeater's classes and regular classes by wearing hiijab."
