NEW DELHI: Holding that examinees are entitled to look their resolution sheets of aggressive checks, the Supreme Court has directed Uttar Pradesh Public Service Commission to allow applicants to check up on their resolution sheet without disclosing the id of the examiner.
A bench of Justices Madan B Lokur and Deepak Gupta put aside the order of Allahabad prime court which had held that examinees did not have right to look resolution sheet. Referring to previous verdicts of the apex court, the bench mentioned that there used to be indisputably that applicants had been entitled to check up on the answer sheet.
The court passed the order on a petition filed via Mradul Mishra in opposition to HC order. Advocate Meenesh Dubey, appearing for the petitioner, contended that HC erred in passing the order as it used to be contradictory to apex court’s previous judgement which had held that inspecting frame did not grasp the evaluated resolution sheets in a fiduciary capability and the examinees had been entitled to look the answer sheet underneath Right to Information Act.
Agreeing with Dubey’s contention, the bench mentioned, “In our opinion, permitting a candidate to check up on the answer sheet does no longer involve any public hobby nor does it impact the efficient operation of the federal government. There are issues of confidentiality and disclosure of delicate information that can get up, but those have already been looked after with regards to Aditya Bandopadhyay where it has categorically been held that the id of the examiner cannot be disclosed for causes of confidentiality. That being the location, we don't have any doubt that the appellant is entitled to check up on resolution sheets”.
