Haryana rapped for not releasing allowances to retired judge

CHANDIGARH: Upset over the lengthen and non-payment of allowances to Justice Iqbal Singh, who had served as commissioner, gurdwara elections, Haryana, the Punjab and Haryana high court has directed the Haryana govt to unlock the amount within 3 weeks. The HC has also warned the state that during case the charge isn't made within the given time, the secretary of the dep. concerned shall stay provide ahead of the HC on July 27.
“In our opinion, prima facie, it does not behove of the government to treat a retired pass judgement on of the high court in this method. It used to be the government which selected to appoint him as commissioner for containing loose and fair elections. Hence, we name upon the state of Haryana to record a sworn statement within 3 weeks as to the duration within which all bills will likely be made to the petitioner,” noticed a department bench comprising Justices A B Chaudhari and Kuldip Singh.

The bench additional held, “In case, the affidavit isn't filed, the secretary concerned of the dep. will stay provide ahead of this court on July 27.”

The HC has passed those orders after listening to the petition filed via Justice Iqbal Sigh, a retired high court pass judgement on who used to be appointed the commissioner in August 2014. His appointment used to be made after the Haryana Sikh Gurdwara Management Act, 2014, used to be implemented for the control of gurdwaras in Haryana. In his plea, filed in April 2017, Justice Iqbal Singh had alleged that the government had didn't unlock the salary, allowances and concessions to him from the date of his joining as commissioner until date, except the duration when he used to be serving as the chairman of the Haryana Statute Review Committee from July 24, 2015, to September 24, 2016.

When the topic came up for listening to on July five, the HC noticed that being a retired pass judgement on of the high court, the petitioner used to be appointed as commissioner, gurdwara elections. Obviously, the government is deemed to have knowledge that the retired pass judgement on of the HC can be entitled to the bills and other amenities except pension and there may also be no dispute about it, noticed the bench.

“The answer of the Haryana govt also shows that there is not any dispute about it. However, the reply is silent about other small things like charge of water, electrical energy, gasoline, phone and furnishing charges and salary of peons, and so forth. during the relevant duration through which the petitioner labored as a commissioner,” the HC has noticed whilst adjourning the topic for July 27.
