HYDERABAD: Justice P Naveen Rao of the Telangana high court docket on Thursday issued notices to Rachakonda police asking them to show their stand inside of two weeks on a plea that charged them with ill-treating a Bharatiya Janata Yuva Morcha (BJYM) leader, slapping the repealed section 66-A of IT Act on him and sending him to jail.


The pass judgement on used to be dealing with a petition filed via PM Sai Prasad of BJYM, who used to be arrested via Neredmet police for making allegations of corruption against Malkajgiri TRS MLA Mynampalli Hanumanth Rao. The petitioner used to be reportedly spreading messages against the MLA on social media. The petitioner in his plea said the MLA bore a grudge against him as a result of he used to be wondering his alleged corrupt practices. The police were appearing on the behest of the MLA, he contended. Sending offensive messages used to be a punishable offence underneath section 66-A of the IT Act, but Supreme Court struck down this section and hence police cannot invoke this section, he said.


Petitioner’s recommend P Sashi Kiran took the court docket’s permission to ship non-public notices to the MLA, his follower Sira Rohit and also to the Malkajgiri magistrate. In Sai Prasad’s case, the police slapped section 66-A and the Malkajgiri magistrate too without verifying the validity of the section, sent him to judicial remand, the recommend said. The petitioner narrated that he used to be picked up from a theatre corridor. He additional said that cops instructed him not to query the MLA. He also alleged that there were open threats to him and that his arrest used to be hatched via the MLA himself. “The police cannot arrest an individual in a case of this nature. Prior understand underneath section 41-A of CrPC has to be given,” he said. He sought Rs five lakh repayment and a probe.
