BCCI ethics officer dismisses charge against Sachin Tendulkar

NEW DELHI: BCCI Ethics Officer Justice DK Jain on Monday dismissed the 'warfare of interest' allegations against Sachin Tendulkar after the cricket icon refused to be a part of the Cricket Advisory Committee (CAC) unless he is provided with agreeable 'phrases of reference'.

Jain, in a two-page verdict, described the allegations as "infructuous" (unnecessary), ruling that the subject had to be disposed off after Tendulkar made his position transparent that he will now not "act as such" a member of the CAC.


"Once the BCCI furnished the terms of reference and tenure, he will decide on the course of his participation in the same. Mr Tendulkar doesn't consider himself to be part of any Cricket Advisory Comittee and will not act as such. In consequence, the present complaint doesn't survive for adjudication."

"....resultantly, the present complaint is rendered infructuous and is disposed of, as such," Jain wrote in his verdict.

Jain, who could also be BCCI Ombudsman, mentioned Tendulkar, thru his criminal Counsel Amit Sibal had issued a commentary, which was once sufficient to dismiss the case.

Tendulkar's criminal recommend's commentary learn: "Without prejudice to his rights and contentions within the present continuing, Mr. Sachin Tendulkar wishes to reiterate that he has been asking for BCCI since the inception of the CAC that phrases of reference and his tenure is furnished to him.

"He has asked this time and again and a number of other times over time together with as not too long ago as on 7.12.2018. He is now left with out a other selection but keep up a correspondence to BCCI that until and unless the BCCI furnishes the phrases of reference and tenure of his appointment within the CAC, he has determined now not be a part of any committee of the BCCI together with the CAC."

It successfully means that Tendulkar would possibly not be part of the new trainer selection process after World Cup unless CoA provides correct phrases of reference.


It was once Madhya Pradesh Cricket Association (MPCA) life member Sanjeev Gupta, who had alleged that each Tendulkar and VVS Laxman are conflicted for appearing dual roles as CAC member as well as mentor/icon with their franchises Mumbai Indians and Sunrisers Hyderabad respectively.


However, Tendulkar in his affidavit had categorically denied that he has any monetary agreement in each his roles and hence does not come under tractable 'warfare of interest'.


It has been learnt that CoA is in a position with phrases of reference and might be handed over to him now that the case is over.
