400 buyers wait for flats, move consumer court

GURUGRAM: The National Consumer Disputes Redressal Commission (NCDRC) has issued a notice to city-based developer MVL Limited after a group of consumers approached the highest shopper court with court cases of delay in construction of The Palms housing challenge in Bhiwadi, slightly 50 km from Gurgaon.

A complete of 400 consumers have invested in the challenge, which used to be launched by way of MVL 5 years in the past with a promise of possession by way of 2016 that used to be later revised to 2018. But till now, investors say, the construction work has not even started on the challenge web site.

"The developer has charged us the 'starting of construction charges' and has already taken 30-35% of the total property cost from all the buyers, but work has barely started at the project site," mentioned Varun Sharma, some of the aggrieved homebuyers.

The NCDRC admitted the petition of a group of 35 homebuyers towards the developer on November 2. The subsequent date of hearing in the case is on March 2, 2018.

Homebuyers instructed TOI that over the last couple of years, they have attempted coming near all of the government concerned in Gurgaon and Delhi however were given no relief.


"We tried approaching the developer multiple times and also went to Gurgaon police and Delhi Police with our grievances. However, after seeing no relief, we were forced to knock the doors of NCDRC," mentioned Dilip Kumar, another aggrieved homebuyer.


The developer has had bother with its other projects as neatly and more than one parallel instances are going on. Around 250 consumers are also stuck in its industrial challenge, known as IBC in Gurgaon, which used to be bought beneath the 'confident returns' scheme.


In the similar case, SEBI had in 2015 asked MVL to go back the money to the investors because the scheme used to be itself unlawful. However the developer hasn't but complied with the order. A case is also going on towards the developer in Delhi high court after a petition for completing of commercial used to be filed in 2015.


Despite repeated makes an attempt, the developer could not be contacted.
