Justice Kurian Joseph slams government over Supreme Court stand-off

KOCHI: For the second time in simply over per week, Supreme Court judge Justice Kurian Joseph on Sunday chose to publicly express his disagreement with the Centre on the issue of Uttarakhand High Court Chief Justice Ok M Joseph's proposed elevation to the apex court docket, saying, "Things that shouldn't have happened are happening. Things that haven't happened so far are also happening."

On the sidelines of a guide free up at Ernakulam Town Hall, Justice Kurian said, "The list of names sent by the collegium getting altered, cut short and later sent back has never happened before... The hope is that there would be discussions on how it happened so that it wouldn't happen again."

On April 28, he had informed journalists in Thrissur that the collegium, which was scheduled to fulfill on May 2, was making plans to send back Justice Joseph's name to the Central executive for reconsideration. However, the collegium due to this fact made up our minds to defer dialogue on the topic.

Reacting to the remarks made by way of Justice Kurian then, a senior executive respectable had said it was “distressing” to peer a member of the collegium discussing within the open “whom to nominate and whom to not”. Pointing out that there was a well-established tradition that judges didn’t discuss their minds on such sensitive issues, the respectable questioned at the appropriateness of the collegium assembly if choices had already been taken unofficially.

In Thrissur on April 28, Justice Kurian had also dwelt on the issue of regional illustration and seniority and said that they might not be the main criteria for collection of judges to the apex court docket.

It is also recalled that the Central executive had requested the collegium to rethink Justice Joseph's nomination, saying that his elevation would increase the choice of judges from the Kerala High Court within the SC to 2, although many high courts wouldn't have any illustration within the top court docket's bench. The executive had also contended that there many HC leader justices senior to Justice Joseph.


Opposition events, then again, have claimed that Justice Joseph is being penalised for a 2016 verdict through which he had struck down President's Rule in Uttarakhand, a fee denied by way of the government.


In a letter to CJI Dipak Misra, Justice Kurian had sought a complete court docket assembly to talk about the Centre dilly-dallying on collegium suggestions to nominate Justice Joseph and senior recommend Indu Malhotra as judges of the SC.
