Former BJP MLA Nalin Kotadiya declared absconder

AHMEDABAD: A city sessions court docket on Monday proclaimed BJP ex-MLA Nalin Kotadiya an absconder in connection with the debatable Bitcoin extortion case.

Allowing a request by the CID (crime), additional sessions judge P J Tamakuwala stated, “The court docket is subjectively glad that Nalin Kotadiya has absconded or has been concealing himself so proclamation under Section 82 of the Criminal Procedure Code is required to be published…the court docket has no different possibility but to issue a written proclamation.”


The court docket ordered for issuance of proclamation against Kotadiya after the investigating company could now not serve an arrest warrant on him in spite of repeated makes an attempt. This led the court docket to conclude that Kotadiya was evading arrest, stated public prosecutor Sudhir Brahmbhatt.


The city sessions court docket ordered Kotadiya to surrender ahead of it inside of 30 days or else it's going to begin process against him in line with the regulation. The provisions of Section 83 of CrPC provides for attachment of assets of the absconder, who fails to reply to the proclamation under Section 82 of CrPC.


Meanwhile, the court docket also issued an arrest warrant under Section 70 of CrPC against one Jatin Patel, brother of Ketan Patel, an recommend from Surat who is also an accused when it comes to bitcoin extortion. Patel is supposed to have been the liasion between Kotadiya and different accused within the case.
