U'khand cop seeks hefty damages from Delhi police

NEW DELHI: Accusing the Delhi Police of humiliation and intellectual trauma, an Uttaranchal cop has moved the Delhi top court in the hunt for round Rs 70 lakh as compensation.
Justice Rajiv Shakdher recently heard the plea of Vivek Chaudhary, who used to serve in the Uttaranchal Police with an unblemished file, until he used to be implicated in a case of faux currency notes by Delhi Police’s Special Cell and right away after his arrest in 2007, his photos have been printed in the print and digital media, dubbing him as an anti-national.

After being acquitted by a court following a complete trial, Chaudhary now wants the police to compensate him for the misery and agony he underwent all over a year at the back of bars.

Siddiqui argued that the rights of his consumer, enshrined underneath Article 21 of the Constitution, have been trampled upon due to “unwarranted incarceration, hardships, harassment, mental-physical agony and social ostracism suffered as a result of publicising his photos as an anti-national in the digital and the print media and as a result of false implication by officers of Delhi Police’s Special Cell.”


Chaudhary instructed HC that even the trial court recorded lapses at the a part of the prosecution. “The illegal acts of Delhi Police by falsely implicating the petitioner and causing physical and intellectual harassment to him have been obviously violative of the legislation and thus led to severe infraction of Article 21 of the Constitution because the petitioner’s proper to recognition and liberty used to be impinged by protecting him at the back of bars and circulating his photos as an anti-national,” the plea added.


The Special Cell, on the other hand, defended its actions. In an affidavit, the police unit countered by citing the trial court judgment and argued that Chaudhary in truth gained the advantage of doubt, and no longer an honourable acquittal.


In its reaction, the Special Cell also disputed the opposite allegations levelled by Chaudhary, terming those as baseless and frivolous, including that the police officers best did their duty but the petitioner is now pasting motives without evidence.
