HC dismisses PIL against shifting of turtle sanctuary

ALLAHABAD: The Allahabad prime court has pushed aside a PIL which asked the court to direct the authorities involved to give protection to the Turtle Wildlife Sanctuary in Varanasi and not to shift it upstream, but even so preventing plying of motorboats, inland waterways vessels and ships in the safe sanctuary house and in addition forestall human activities.
Dismissing a PIL filed via Bharat Jhunjhunwala, an environmental activist and a retired professor of IIM, Bangalore, a department bench comprising Chief Justice Govind Mathur and Justice Dr Yogendra Kumar Srivastava stated it might be open to the petitioner to post his tips, if any, ahead of the authorities involved.”

The court stated, “The proposed choice is based on the opinion of professionals and after following due procedure under legislation, there does not seem to be any subject material illegality in it.”

Earlier, on December five the court had reserved its order on the PIL.

According to petitioner, the sanctuary was notified in 1986 and established in a seven kilometre house of river Ganga, between Ramnagar and Malviya bridge of Varanasi.


It was alleged via the petitioner that the sanctuary was being shifted best to make approach for inland vessels in river Ganga under a government venture facilitating transportation through waterways.


Studies the world over display that motion of vessels in rivers adversely impact aquatic life. Therefore, such initiatives should not be approved to save aquatic life, the PIL stated.


The motion of vessels would prove to be an environmental hazard, as the same would adversely impact aquatic animals and their actions in the Ganga river. The court delivered this judgment on January 4.
