CHANDIGARH: The Punjab and Haryana top court has commuted dying sentence of a Ludhiana resident, who had killed his cousin and aunt in 2013, into life imprisonment.
Rishu Grover, who was once in a courting along with his cousin Heena, was once infuriated when her marriage was once mounted with any individual else. Heena, 21, an her mother Usha Rani , 55, had been found dead in their space in Mohalla Fatehgunj on May 22, 2013. The police had arrested Usha’s nephew Rishu Grover, 30, on the observation of her son Rahul Grover. Police claimed that Rishu wanted to marry Heena and was once infuriated when her marriage was once mounted with any individual else. After committing the murders, Rishu had also escaped with cash and jewellery.
Later police had recovered the knife, surgical gloves, and handkerchief from the accused on the basis of his disclosure observation.
In September 2018, the Ludhiana district court had awarded dying sentence to Rishu while staring at it as “rarest of the uncommon” case.
While commuting the dying sentence into life imprisonment, department bench headed by Justice Rajiv Sharma held that the rarest of uncommon instances comes when the convict would be a threat and threat to peaceful life of the society. It was once additional observed that aggravating circumstances shall also be considered while deciding such instances.
“This case does now not fall inside the ambit of the primary of rarest of the uncommon instances for awarding dying sentence to the appellant. Death sentence awarded to the appellant is commuted to life imprisonment out of which the appellant must necessary serve out minimal 20 years with out remission and to pay a high-quality of Rs 50,000,’ the HC has held.
Division bench comprising Justice Rajiv Sharma and Justice G S Gill has handed these orders while deciding the murder reference gained from the Ludhiana court.
