Legal notice to MCG for policy mandating registration of pet dogs

GURUGRAM: Animal rights activist Anjali Gopalan and city resident Chetna Joshi have served a prison notice to MCG for its coverage mandating registration of pet canine throughout the municipal house. According to them, the coverage is unconstitutional and towards Animal Birth Control Rules, 2001, and Prevention of Cruelty to Animals Act, 1960.

The notice, a duplicate of which has been accessed by TOI, stated the aforementioned Acts have been central rules and outdated Section 311 of Haryana Municipal Corporation Act, 1994, which, due to this fact, was unconstitutional and invalid. It added that the topic was additionally sub judice before the Supreme Court which on November 18, 2015 directed all local authorities to strictly observe the central rules and not come up with “subterfuge or innovative methods” to bypass its order.


“Section 311 of the municipal Act states that any canine found in a ‘public place’ without a ‘tokened’ collar shall be detained and ‘destroyed or otherwise disposed of’, unless it's claimed and the price paid, which is unconstitutional and unacceptable,” stated Joshi. Earlier too, the duo had served a prison notice to MCG on this topic.


“Two different municipalities have been not too long ago pulled up by the Supreme Court for contempt as they didn’t comply with its order. We are hoping that after this notice, MCG will cease the registration of pet canine,” added Joshi.


When contacted, MCG commissioner Yashpal Yadav stated that the SC order limited elimination of strays and not registration of pet canine. “Registration of pet canine is inside our powers and can assist keep watch over the stray canine risk and maintain canine in terms of vaccination and sterilisation,” he added.
