CHANDIGARH: As the offences under the Negotiable Instruments Act are increasing day by day, the court of Navneet Kaur, judicial magistrate first-class (JMIC) has sentenced one person to ten-month easy imprisonment. The accused could also be directed to pay Rs five.14 lakh as compensation.


The criticism was once filed via Capital First Limited in Sector 26 , now known as IDFC First. As per the criticism, accused identified as Vijay Kumar Garg, approached the company for a industry loan along with agreed rate of interest. Garg had submitted more than a few paperwork required and agreed to pay the quantity with pastime in per month installments. In December 2016, Garg had issued a cheque amounting to Rs five.14 lakh drawn on Jogindra Central Co-operative Bank Limited, Baddi, HP in favour of the complainant, with an assurance that cheque would be encashed as and when offered. But it was once dishonoured with remarks of 'insufficient finances' in his account.


Thereafter, a criminal understand was once sent to the accused to make payment within 15 days however he didn't pay the quantity. Hence, the complainant moved court. The defence recommend mentioned Garg has been falsely implicated. He argued that the complainant has misused the clean signed cheque which was once given via him as security at the time of taking the loan.


H S Kathpal, recommend for the complainant, mentioned no leniency must be taken towards the convict. The court noticed that Garg has dedicated a serious offence via intentionally failing to pay the quantity in discharge of his financial legal responsibility and has failed to ensure the payment of cheque drawn via him. "The interest of justice would be met if the convict is sentenced to simple imprisonment for a period of ten months of commission of offence punishable under the Negotiable Instruments Act, 1881," the order said.
