NAGPUR: The Nagpur bench of Bombay High Court on Thursday issued notices to attorney common of India on a PIL filed through a social employee praying for freezing of election symbols of main political events for 20 years.

According to Mrinall Chakravorty, the symbols give undue advantage to established events while for other contestants those are equipped simply 15 days before the ballot dates. ECI has an unconstitutional policy of classifying political events as recognized and unrecognized beneath the ‘Election Symbols (Allotment and Reservation) Order’ of 1968, in accordance with previous election results, and dispensing symbols accordingly.


The 50-year-old petitioner, who appeared in-person, further pointed out that the recognized political events were given reserved symbols, which became a brand over a time frame, and in an instant recalled through the citizens. On the other hand, unrecognized events simplest were given their image 15 days prior to balloting, giving them virtually no time to create visibility in public eye. He termed this “inequality”, a direct violation of Article 14 of the constitution.


Earlier, the court had issued notices to Election Commission of India (ECI) and Union Ministry of Law and Justice.


The petitioner prayed for declaring 1968 order as arbitrary and unconstitutional and to direct the ECI to prevent classifying events as recognized and unrecognized. He further asked to allot unreserved election symbols to all applicants at the identical time, while providing different symbols to applicants from identical birthday celebration however from different constituencies. A proposal for allowing the photograph of the candidate to be displayed at the ballot paper has additionally been made.
