Noida-Ghaziabad schools' fee hike: Court directs government to compensate petitioners

NOIDA: Hearing a petition filed by way of the oldsters of Noida-Ghaziabad towards personal colleges charging fee arbitrarily, the Allahabad High Court has directed the state government to compensate the petitioners with exemplary prices as could also be determined by way of the Court in case it fails to report a reaction on what motion has been taken for compliance of the Right of Children to Free and Compulsory Education Act (RTE), 2009 as also Article 21-A of the Constitution by way of the next date.
The state government which is a respondent within the case had to listen tough words from the one bench of Justice Manoj Misra on October 5 when the court docket had directed it to report a counter report on February 5.

The government has now sought more time from the court docket for compliance of the top court docket order. However, the court docket noted on Thursday that no counter report has been filed by way of the state on subsequent hearings on February 5 and February 22.

The petition has been filed towards other personal colleges of the state for indulging in “arbitrary fee hike” together with the ones in Gautam Budh Nagar, Ghaziabad and Kanpur.

These had been clubbed with the writ petition 46207 filed by way of Shailendra Kumar Singh of Ghaziabad and others towards 12 respondents in 2017.

In an order handed by way of the court docket on January 12 this 12 months, the Court had directed that an authentic no longer beneath the rank of an extra secretary in primary education department will have to report a sworn statement within the subject.

Listing the case on March 15, the court docket has said that if by way of the next date, counter affidavit isn't filed, the “respondents shall compensate the petitioners with exemplary prices as many be determined by way of the court docket at the next date.”


Around 29 cases which were filed towards other personal colleges of the state for indulging in “arbitrary fee hike” by way of them together with the ones in Gautam Budh Nagar, Ghaziabad and Kanpur.
