MUMBAI: A homeopathy student barred from attending faculty because she wears the hijab (headband) has moved court docket announcing she is now being averted from appearing for repeater checks in June as a result of poor attendance.

Bandra resident Fakeha Badami enrolled within the bachelor of homeopathy drugs and surgery direction in Sai Homeopathic Medical College, Bhiwandi, in 2016.



The faculty, affiliated to the Maharashtra University of Health Sciences (MUHS), didn’t permit her to wait lectures because she wears the hijab.

The ministry of AYUSH (ayurveda, yoga and naturopathy, unani, siddha and homeopathy) directed the varsity to resolve the issue, announcing “it can't compel a student not to put on the hijab since it's disrespect to social justice”. MUHS wrote to the state medical schooling and medicine division to know if there was any regulation barring Muslim students from wearing the hijab. It mentioned she should be allowed to wait faculty.

But the varsity did not budge. By the time Fakeha approached the top court docket the primary time, in November 2017, the varsity checks have been over.

Homoeopathy student Fakeha Badami’s faculty instructed the top court docket that it would accommodate her in repeater lectures. Sai Homeopathic Medical College, Bhiwandi, was directed by means of the HC to means Maharashtra University of Health Sciences (MUHS) and seek its recommendation on laws and regulations.

This induced her to means the HC again. Fakeha’s petition mentioned the primary term started on December 27, 2016. She attended faculty on December 28 and to her “utter shock and dismay” all Muslim students have been being “coerced” to take away the hijab.


The students both stopped wearing the hijab or left the varsity. Fakeha’s petition states that she was harassed as continued wearing the hijab. As in keeping with her petition, her oldsters instructed the varsity Fakeha wore the hijab even in class and junior faculty. “India is a... secular democracy. Denying any individual... the correct to put on the hijab is denying her the correct to practice a religion of her choice, despite such right being obviously protected by means of the Constitution of India as a Fundamental Right underneath Article 25,” the petition said.


“The faculty is underneath obligation to practice secular tenets.” The petition mentioned Fakeha’s sister, studying homeopathy in another MUHS faculty, wears the hijab and is allowed to wait categories. Fakeha’s suggest, Sariputta Sarnath, instructed a holiday bench of Justices Shahrukh Kathawalla and Ajay Gadkari on Monday that Fakeha was allowed to wait categories most effective after the HC’s March 12 order and her lack of attendance was due to the varsity no longer permitting her to wait categories.
