MUMBAI: The Bombay High Court on Wednesday allowed a minor rape survivor to terminate her 24-week being pregnant, taking into account her "tender age" and the fact that she had already suffered sufficient trauma.
A vacation bench of justices A K Menon and Bharati Dangre handed the order on a petition filed through the 16-year-old woman's mother, searching for permission to terminate her daughter's being pregnant.
According to the Medical Termination of Pregnancy Act, an abortion past 20 weeks of being pregnant will also be achieved most effective upon getting the top courtroom's nod.
The woman had filed the petition previous this month, after her daughter complained of abdomen ache and was taken to a health facility.
She had claimed that she got to learn about her daughter's being pregnant most effective then.
According to the petition, the lady was allegedly raped through a relative's friend.
The courtroom had remaining week directed that the lady be tested through a unique panel of professionals and medical doctors on the Rajawadi health facility.
The panel had submitted a report back to the courtroom, stating that the lady was medically and bodily fit for termination of being pregnant.
"We have perused the report. Considering the tender age of the girl and the fact that she has already undergone enough trauma, making her go ahead with the pregnancy would only cause further trauma. Hence, we allow the petition and permit the girl to undergo medical termination of the pregnancy," the courtroom said as of late.
It added that the termination of being pregnant will have to be performed on the KEM health facility in central Mumbai because it was higher equipped in case of an emergency.
The courtroom additionally said the lady will have to be transferred from Rajawadi health facility to KEM health facility and the procedure to terminate her being pregnant will have to be completed through tomorrow.
