NEW DELHI: The Delhi high courtroom on Friday sought Centre's response on a PIL in quest of path to utilise biometric and Aadhaar main points of lacking individuals, including kids, aged and mentally challenged, so that they can be reunited with their families.

A bench of Acting Chief Justice Gita Mittal and C Hari Shankar issued notice to the ministry of home affairs at the plea which also sought path to the authorities to unfold consciousness in this regard to trace the pre-existed biometrics and Aadhaar main points for reuniting lacking individuals with their families around the country.

The bench requested the ministry to report an motion taken document at the representation made via petitioner advocate Amit Sahni to the authorities and indexed the subject for further hearing on November 13.

The petition said the Centre be directed to factor suitable and mandatory directions to the authorities for utilising biometric/Aadhaar of lacking kids, outdated aged individuals and mentally challenged individuals straight away for the purpose of tracing and reuniting them with their families as and when they're rescued via any division.

It said the petitioner used to be now not challenging any query of legislation, which is already pending adjudication ahead of the Supreme Court, this is, the constitutional validity of Aadhaar.

"There have been many debates regarding Aadhaar and the issue of its constitutional validity is pending before the Supreme Court of India but the same is very useful for tracing missing persons, if the Aadhaar of such missing persons is pre-existed," it said.

The plea referred to the statistics of National Crime Record Bureau (NCRB) 2016 as according to which the full lacking individuals are five,49,008 and untraced ones are three,19,627.


"There is no greater vacuum or void than the helplessness felt by parents whose children have gone missing and the significance of timely recovering of the missing child can only be understood if one empathises with feelings of the missing child or that of a mother, who is unable to locate her child irrespective of the circumstances under which a child goes missing," it said.


Sahni also referred to a judicial order in which via the intervention of a tribulation courtroom, a 31-year-old mentally challenged girl used to be reunited together with her family in Rajasthan via Aadhaar.


In that case, a mentally challenged girl used to be rescued via Delhi Police and produced ahead of Metropolitan Magistrate Abhilash Malhotra, who directed the authorities to assist the victim to go through the method of Aadhaar, which printed that her biometric data pre-existed in the Aadhaar database.


The police acquired her main points from the Unique Identification Authority of India and then she the lady used to be reunited together with her family.
