Thane: Man gets one-month jail for stalking minor girl

THANE: A 25-year-old guy was once sentenced to one-month imprisonment by a court for stalking a minor woman.

District judge VY Jadhav, in his order passed on Tuesday, additionally imposed a nice of Rs 20,000 on the accused, Shivkumar Mourya, after pronouncing him guilty underneath the Indian Penal Code's Section 354D (stalking) and related provisions of the Protection of Children from Sexual Offences (POCSO) Act.

The accused had previous served one-month in jail following his arrest in the case.

The accused used to continuously stalk the Class X woman in 2015 when she would cross to school.

Once whilst she was once travelling in a bus, he sat subsequent to her and attempted to the touch her inappropriately, the prosecution informed the court.

The woman later reported the topic to her mom.

Based on the mom's criticism, police lodged an FIR against the accused and therefore arrested him. The accused was once in custody for a month sooner than getting bail in the case.

The prosecution informed the court that even though the accused had never threatened the woman, he ceaselessly adopted her, causing psychological trauma.

In view of this, the prosecution demanded most punishment (3 years) to him underneath the related sections.

However, the defence recommend submitted that considering the age of the accused and shortage of any felony antecedents, he is also awarded a minimum punishment or a sentence for the length which he had already been in custody.

After listening to each the edges, the judge mentioned that considering the age of the accused and lack of any felony antecedents, "in my view, directing him to suffer imprisonment of lesser period like one month along with the fine would suffice the purpose".
