Kapil Sibal appears for Ahmed Patel, objects to Rajput’s plea

AHMEDABAD: Senior recommend of the Supreme Court and former minister Kapil Sibal on Wednesday appeared ahead of the Gujarat prime court docket on behalf of senior Congress leader Ahmed Patel and raised several objections to the petition filed via BJP candidate Balwantsinh Rajput, who has challenged the Rajya Sabha election effects.

Rajput approached the HC in August last 12 months after he was defeated via Patel, who were given 44 votes towards the 38 votes secured via Rajput. Rajput wondered the ECI’s resolution to carry two votes via revolt Congress MLAs – Raghavji Patel and Bholabhai Gohel – invalid, as they'd shown their votes to other people other than the Congress celebration’s representative. Rajput held that the returning officer had declared those two votes as legitimate and the ECI had no jurisdiction to claim them invalid. Thus the ECI’s intervention in the issue and its order is prohibited and must be set aside.


Sibal objected to Rajput’s making the election fee a celebration in the litigation. Rajput’s lawyer rebutted via submitting that the grievance was towards ECI’s resolution and therefore making it a celebration respondent in the application was justified.


Sibal additionally argued that Rajput didn't remove administrative center objections from his election petitions and the appliance was no longer filed in the method that HC norms require it to be.


The court docket reserved its order on Sibal’s objections till March 20.
